These Terms of Service (“Terms”) govern your use of the Noltis iOS app. By tapping Quick Login or otherwise using the App, you agree to these Terms and the Privacy Policy.

1. The service

Noltis is an AI Micro Habitat Studio. You pick a habitat style, photograph or choose a real corner, shelf, or tabletop, optionally add a short note, and receive a miniature habitat AI preview.

The preview is decorative inspiration. It is not:

• horticulture, watering, lighting, or plant-care advice;
• pet, wildlife, or aquarium husbandry;
• electrical, construction, or interior-build guidance;
• a photograph of a real installation you can order as-is.

If plants, creatures, water, or glow appear in a preview, treat them as stylized silhouettes, not living subjects or safety-certified products.

2. Artificial intelligence

Habitat stills are generated by a third-party AI image model (Agnes AI, model agnes-image-2.1-flash) from the photo and text you submit. Outputs can be inaccurate, surprising, or unlike your real space.

You understand and agree that:

• AI previews may alter objects, lighting, and materials;
• a marked “preserve” rectangle is a best-effort hint, not a guarantee;
• the App does not warrant that generated content is unique, non-infringing, or fit for any commercial print or build;
• you will not present an AI preview as a real photograph of work you completed, as medical/horticultural advice, or as an official certification.

Details of what is sent to the model (photo + prompt text, including any incidental faces) are in the Privacy Policy, Sections 4 and 5.

3. Photos, likeness, and acceptable use

You must only submit photos you have the right to use. Do not generate from images of other people, children, or private property if you lack permission.

You agree not to use Noltis to:

• create sexual, exploitative, or illegal imagery;
• harass, impersonate, or defame anyone;
• attempt to reconstruct a biometric identity from a photo;
• probe, disrupt, or overload the App or the AI provider;
• reverse engineer the App for malware or unauthorized access.

We may refuse or interrupt generation that appears to violate these rules. Local safety filtering may block a run; blocked or failed runs are not charged Spores.

4. Accounts

Quick Login creates a local studio on this device (a random username and password stored only on device). There is no password-reset email flow.

Logout clears the session but keeps local data. After logout, opening the App shows Login until you tap Quick Login again.

Delete Account permanently erases local studio data on this device, including Spores, notes, and previews. This cannot be undone.

5. Spores and In-App Purchase

Spores are a virtual currency used to start a successful habitat generation (currently 10 Spores per successful preview; first Quick Login may grant a one-time welcome amount). Failed, cancelled, or blocked runs are not charged.

You buy Spores only through Apple In-App Purchase. Pack names are gift-pack / chest style labels. There is no Restore Purchases control. Spores have no cash value, are not transferable, and are not redeemable for money. Payments, taxes, and refunds are handled by Apple under Apple’s terms.

6. Intellectual property

The App, catalog copy, and design belong to the operator of Noltis. You keep rights in photos you own. You grant Noltis and the AI provider a limited license to process those photos solely to generate your requested preview. Generated stills are licensed to you for personal, non-commercial inspiration inside the App unless a separate written grant says otherwise.

7. Disclaimer of warranties

THE APP AND ALL AI PREVIEWS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED SERVICE, ERROR-FREE GENERATION, OR THAT PREVIEWS MATCH PHYSICAL REALITY.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF NOLTIS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST SPORES, OR RELIANCE ON AN AI PREVIEW TO BUY PLANTS, PETS, OR BUILD MATERIALS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR SPORES IN THE THREE MONTHS BEFORE THE CLAIM (IF ANY).

Some jurisdictions do not allow certain limits; in those places, our liability is limited to the fullest extent allowed.

9. Termination

You may stop using the App and delete your account at any time. We may stop offering the App or the AI provider may change or withdraw the model. We are not obligated to host historical previews outside your device.

10. Changes

We may update these Terms. The “Last updated” date will change. Continued use after an update constitutes acceptance.
